The hearing was called to order at 8:09 p.m.

Applicant seek two findings and a special Permit relative to proposed garage expansion on a nonconforming lot.  Property is located at 186 Morse St. and is situated in the Rural 2 Zoning District within the Surface Water Protection District.

Conservation Commission letter dated 05/09/05 read.  Stating no objection.

Board of Health letter dated 05/10/05 read.  Stating the current septic tank must be upgraded to a 1500 gallon tank.  The Applicant has agreed to do so.

 

Applicant described plans for a two story addition to renovate the second floor bedrooms and a new garage.  The master bedroom will be enlarged to add full bathroom and walk-in closet.  The other two bedrooms will also be enlarged.  The lower level will be a 26 x 14 garage.  The new master bedroom will be above the new garage.

 

The existing living space 1186 sq. ft. and proposed living space 209 sq. ft..

 

Michael and Jodi Bennett residents of 198 Morse St. stated they approve of addition.

Applicant seeks a Comprehensive Permit under MGL Chapter 40B, Section 20-23 for development of thirty-two town house condominium units, comprised of nine buildings, plus one existing home located at 9 Glenview Road.  Property is located off Rob’s Lane, Town of Sharon Assessor’s  Map 102-Parcels 87,88 and 92-1 and is zoned Residential B.

John noted that the Board met previously in open meeting to discuss concerns with Density, water supply, wetlands, and setbacks from neighbors property.  

 

John also stated the Board’s role is not to re-design the project, but to discuss concerns to approve or deny.  Walter noted that there would be impact on Sharon School system and stated that it is important that the Applicant address that consideration.

 

Attorney Peter Freeman, representing Applicant.  He noted that CHAPA did a study that found condominiums do not impact schools because the condominium members have fewer school age children.  There was discussion about condominiums and children.

 

Attorney Freeman also spoke about hydrant flushing never took place.  With regards to wetlands, Applicant has waivers and does not think there will be any harm due to the development.  With regards to density, Mr. Freeman does not think the number of units can be further reduced.

 

John Rhoades, from Norwood Engineering spoke next.  Depressions were inspected by botanist and depression 1 and 2 were recognized as vernal pools. 

 

Greg Meister stated that the project should be 200 feet from vernal pools and there should be a 100 foot buffer zone.

 

Attorney John Witten wanted to know if the Board has engaged peer review consultants.  John indicated that the Board intends to engage peer review.  Atty. Witten noted with regards to waiver for vernal pool that the applicant needs to demonstrate why the waiver is necessary, and has not provided evidence.

 

Attorney Freeman responded that they have been working on more detailed plans and expect to have final plans in September. 

 

Discussion by Board on organization to use for Peer review.

 

Joanne Douglas, resident of 12 Robbs Lane asked whether traffic study would be included

 

Alice Cheyer resident of Sharon, asked about fire safety in the peer review.

 

Attorney Witten stated that the Applicant should pay for an advocate for the town for legal consulting etc.

 

Mr. Houston indicated there are common concerns regarding ground water and wetlands.  Mounding under the septic system is a concern.  There should be monitoring during the spring and a ground water contour map be done.

 

Paul Skolnik resident of Billings Road indicated issues with ground water during March and April.

 

There was discussion on monitoring wells.

 

Richard asked if the spring water level will be able to be monitored specifically.  Mr. Rhodes discussed motling and ground water monitoring wells.

 

A resident of 30 Glendale Road asked how many times have measurements been taken from wells and how are the measurements taken.

 

A resident of Robbs Lane asked if additional wells will be drilled and will more trees be taken down.

Applicant seeks two special permits relative to parking vehicles from 450 N. Main St. on the property at 440 N. Main Street   Property is situated in the Single Residence A Zoning District

Attorney Paul Lorincz  provided the Board with Parking Management plan.  Stating the required spaces per Zoning By-laws is 36, ITE Medical-Dental office average peak parking is 35 and spaces provided are 49.

 

The Board and the Applicant reviewed  and discussed the Parking Management plan.
